I got all these emails asking me, what my position is on SOPA and PIPA, read my headline again, because I’m half tempted to stop the post right here!

You already know it’s not my style; I also refuse to talk about politics in any situation.  However, this is different and unless you’ve been hiding under a rock for the past couple months, YOU need to know exactly what is about to go down.

So, we’re going to get into it and yes this will be very opinionated so you are forewarned.  Now first of all I would like to thank our elected officials in Congress for making this go down on January 24!  That happens to be my birthday, so could be a very interesting day around here.

Let me first get your attention.  Everybody, I mean everybody is protesting this bill, and as I stated before on January 24, the first stages of the voting process go down.  Now you don’t have a vote, however you can certainly let those boneheads in congress know what you think!  I highly recommend you do.

Take a gander around the internet, you see all the protests?  You can’t miss them.  Even our old friend “Google” is taking a stance.  For once I am on the same page with Google!

I surfed around the web just to show you some of the sites that are protesting, it’s important that we get your attention!

How will SOPA and PIPA affect me?

Great question and I’ll sum it up for you.  Let me start out by saying, I’m not going to be over dramatic, like some of my colleagues, claiming this to be “ The end of the world”, well that is certainly not the case,  but I do think it can be the end of the Information Highway as we know it!

Let me first give you the official definition of these two bills. (SOPA) is a bill that stands for Stop Online Piracy Act, and the second is (PIPA) Protect IP Act. Now, if you’re new to these two bills, you’re probably saying “Well that doesn’t sound too bad”, and at first glance it sounds like a good thing.  You couldn’t be MORE WRONG!

Now, supposedly President Obama is against this bill, and it has been shelved, but there’s no guarantee he won’t sign it.  I’ve seen these bills get signed before when you’re not looking, or when your eyes are closed.  However I hope he does what’s right and understands the consequences of his actions.

No, I’m not attacking Obama, I have my own personal views on politics and I refuse to express them.   However just speaking about politicians in general, they have been known to sneak  in a bill approval after they hype has worn off, or the public awareness is minimized, or you’re busy watching a game on Super bowl Sunday, or you’re sitting in church service, again I’m speaking vague here, but it is the truth.  No matter what your views are, Congress is dirty.  This bill is Dirty!

Now I think the original goals and objectives behind these bills had good intentions.  Even the originator of the bill is now having second thoughts.  As a product creator myself, I think there is a massive problem with piracy and downloading products without permission, and you guys have seen me write post after post showing you how you can combat yourself against those pirates.  However, these bills are way out of control.

Congress has no right to call this bill a “Stop Online Piracy Act.”

I like how Google put it today, “End Piracy, Not Liberty.”

This is not a Bill, This is A Direct Attack on the Internet Sector!

You see, there are two main very ineffective objectives behind these bills.  The first is to give companies the ability to stop domain names that are capable of or encourage copyright infringement.

Who are we talking about here?  A better question is who aren’t we talking about?

Well funny thing about this, like so many other bills it is written in very vague language.  So sites that you have made a daily routine in your life will could very well be targeted for eternal extinction.   Twitter, Facebook, YouTube, Wikipedia and virtually every alternative news site that you can think of!  All of these sites could very well be a SOPA targets.

It’s my belief that Congress has positioned themselves to have the power to remove any website that oppose the US government’s official position on very sensitive issues.

You disagree with me?  That tells me you have not read this bill in its entirety and you probably need to.  Notice how vaguely written this bill is.  It’s just an open door for congress to control the mainstream media that we have come to know as the Internet.

Like that bill, I am going to speak vague here, and I’m really just going to bite my tongue, because I could piss a lot of you off and throw some of my conspiracy theories in here about Global Elite Controllers, Corporate America and their intentions to take over the freedom as we know it, but I’m just not going to go there today.   I’m not here to make enemies.

Besides Congress does anybody benefit from these bills?

Of course, that’s the way our free country works.  I’ll tell you how comes out on top, ‘I’ll make it loud and clear!

The BIG Billion Dollar MOVIE STUDIOS and RECORD Labels benefit from these two bills!

Let’s take a real world example as I know it.  SOPA gives movie studios the power to stop any foreign site against whom they have a copyright infringement claim.  You saying, well wait a minute Chad, you said foreign site.  I live in America, so this doesn’t affect me.  Fair enough… let’s look at an example.

We will use Universal Studios as an example.  Let’s say they have a claim against a site in Romania.  This could be something as simple as a torrent download, or any other kind of copyright infringement.  Well it’s another country right?  United States has no control over foregin countries, and neither does congress.  So if they can’t punish these offending sites, they’re going to after next in line,  the innocent bystanders.  Google is going to be forced to quit indexing the offending site, Paypal is no longer going to be able to accept payments from that site, any ads on that site will be removed, and check this out, this is the most mind-blowing part of all.  The webiste’s ISP will prevent people from ever seeing that site again.

No, I do not think all those sites are innocent by any means, they too have skeletons hiding in the closet!  However, in the example I listed above you could see how they could be viewed as an innocent bystander.

So once again, we have a direct attack on every site you have come to know!  You can argue with me, I’m open to debate… but this is the truth.
Did you get that?  You do not benefit, and even if this bill gets passed the studios will still pay Hollywood Actors and Actresses Millions of dollars to appear in a two-hour film, you will still pay $8.oo for a movie ticket.

You DO NOT Benefit, You Never WILL!

We live in America!  We have a judicial system right?

Well not with SOPA.  You see an IP owner does not even have to appear before our judicial system.  In fact the way SOPA is structured they just need to write a letter stating they have a “good faith belief” that the offending site has infringed on it ownership, or content.   That’s it, it doesn’t matter if it’s a true, or false.

GUILTY, Until proven innocent!

Site’s like Google, Facebook, Paypal, or any other site would then receive a quarantine notice.  At their expense they would need to challenge the claim in a court of law.

Now guy’s a little perspective here.  If you are the defending party, are you going to fight every claim that comes before your desk?

Sure you’re going to protect your investments and sites you have an affiliation with.  However, for the most part the content is going to be removed, payment providers are going to be stopped, Google is going to remove resources that we use every day, and it’s just going to be a never-ending chain reaction.

But Chad, with such severe consequences the piracy will be stopped right?

Absolutely not, as long as there are human beings on this earth there will be thieves.  No,  I’m not calling everybody a thief, but pirates are everywhere, in every country.  Sure they might be stopped for a while, but they’re going to get that “quick buck” as fast as they can.  They will do it time and time again.  They will do it until they get caught.  Not, only that they will find a way around all these bills, policies and practices are government is trying to put into place.  You CAN’T STOP stealing,  I don’t care what our government does.

So once  again, YOU ARE PUNISHED!

At this point, I’ve pissed myself off.  You see my livelihood is affected by this as is yours.  You just might not know it yet.  In the long run SOPA is going to create a “monster black list” of websites that you will never see again.  Even if the claim was completely false, they’re gone!

But Chad, I have faith in our government and our Administration!

I’ll tell you right now, those boneheads in congress are not capable of creating this bill, they don’t even have any business talking about it.  None of those elected officials have the knowledge or expertise to deal with this situation.

What if I told you The Department of Justice and Homeland Security, YOUR GOVERNMENT shutdown 84,000 website because they thought they had links of child pornography on their sites.

THEY WE’RE WRONGLY ACCUSED!

Put this in perspective, if you’re anything like I am.  You have numerous of websites.  You pour your heart into your content, you’ve spent years building up your SEO and backilinks, you have top rankings for your keywords, and then one morning you wake up to this crap on YOUR SITE!

You see where I’m going with this.  I could talk all day on this subject.  People say SOPA is all about CENSORSHIP!

Guys, NO WAY!

SOPA  is so much more than Censorship.

I know I’m bouncing around in  many different directions, but that is because SOPA and PIPA are going to affect so many things in our life.

Let me remind you all of something that will no longer be valid with this bill!

As stated in the 1st and 14th Amendments to the Constitution of the United States, to express information, ideas, and opinions free of government restrictions based on content.

This is your FREEDOM!  These are your RIGHTS!

Yes, this bill is that serious, are you getting it?

I was going to post the amendments in full.  I used to have them memorized back in my college days, but today my memory fails me.  So I decided to just go search Google for the usual suspects.  Wikipedia,  Answers, all the sources I use countless times a day.

Funny thing though, they’re all on STRIKE!  All protesting.  I was crippled today; I struggled with site after site, all being crippled and blacked out.
This is what the consequences of this SOPA and PIPA bill are!

Take it from me…

As a product creator I am able to shut down infringing websites, and I do it every week.  The Digital Millennium Copyright Act(DMCA) gives me the ability to request  the legal removal of any infringing content.

If the accused party refuse to remove it then I can then sue them for damages.   I use this act every day.  I’ve even got a DMCA tool that will issue the DMCA notices for me.  Yes it takes time, but in the end it works!

I am protected, my site is protected, and you know what YOU were not affected and millions of other websites were not affected.  More importantly the Internet as we know it was not affected.

Let me conclude by saying, TAKE ACTION!

I’ve got over 3 hours into this post.  I’m up to over 2000 words.  I didn’t even get to talk about everything I intended such as:

“The Anti-Circumvention Provision”, which gives OUR government the power to target sites THEY believe, is trying to get around their little SOPA bill.

“The “Vigilante” Provision” , which grants broad immunity to all service providers that block innocent users or sites, they can even do so without and judicial system saying it’s ok to do so.

“The “Copyright of Action” , basically a direct attack on payment processors as well as advertisers.  This is why “The Digital Millennium Copyright Act”(DMCA) was formed.

“Expanded Attorney General Powers” If this passed today, the Attorney General Eric Holder and his office would have the power to de-list websites from Google and other search engines, and the ability to block domain name services.

Does this not sound like a Third World Country, under dictatorship?

I hope you get it, if you don’t oh well, you will if this bill passes!

However, if you do understand how detrimental this bill is to you and everybody else then join me.  Let congress know how you feel!  Tell YOUR elected officials they’re out of line, and they need to butt out!

They can’t win this game anyways.

The only way you can win this game is if you can change the way people think and act.  You can’t and our government can’t!  We cannot control what foreign countries for, but we cannot punish millions of innocent users, for their actions.

Does that mean we give up on trying to stop piracy?  Absolutely not!

However, it has to make sense.  You have to protect innocent parties!  The world revolves around the internet.  Our entire financial system as we know it relies on the internet.  What would happen to the stock market if the Internet crashed?  How many companies would end up in bankruptcy?  How many jobs would be lost?

We’re supposed to be getting out of the recession!  This is going to put us right back in!

I hope those officials got a wake up call today.  Our elected administration relies on experts and witnesses for everything.  The President himself surrounds himself around advisers, people who have the experience and expertise when he doesn’t.

Well listen Congress because the experts are talking.  The biggest websites in the world are protesting against this bill.  The same websites that helped you take office.  I suggest you listen closely to the opposition and realize the severe consequences that are to come.

Maybe there needs to be a advisory board that is put together with REAL Internet experts.  People with the knowledge, experience and expertise to come up with a viable and realistic solution.  The bottom line… this is out of the realm of Congress, so tell them to back the hell off!

Share this post, Blast it on Facebook, Tweet the hell out of it!  Digg it, Google Plus.  Hit every button you see in that toolbar to the side.  It’s important that people know the consequences that are coming their way, and much to my surprise people are unaware!

Imagine how unaware people are going to be when these bills are passed.  It’s a scary thought.  As it stands it looks as though this bill will pass!

Last, let me conclude by saying, if you disagree with what I’m saying nobody will ever know.  I usually welcome disputes and debates, but in this case I’m going to show you how this bill will work!  You have NO rights on my blog.  Any of your disagreements, complaints, or arguments will just be deleted!  It doesn’t matter what you think today.  You have no rights!

That is what SOPA and PIPA is going to do to you.  So hope you’re ready ?

    Wow Chad!..Why don’t you tell us how you really feel? LOL..This is good stuff and it made me almost spew coffee on my monitor. In reality people are waking up, and the ones who do not will be left in the dust. This kind of garbage with SOPA and PIPA has got to stop. This is not the country I grew up in. This government is fundamentally transforming my nation into something unrecognizable. I could give a rat’s ass what side of the aisle they sit on, they can all kiss my trucker ass.

    This is a well written piece. I have been hearing about SOPA for the past few days but wasn’t sure exactly what it was and what threat, if any, it was to me. After reading your artice, I am going to personally contact the Georgia senators that favor SOPA and voice my displeasure.

    Chad, I agree. This SOPA bill is very dangerous and will cause more harm than good. Although, fighting piracy is a good thing; unethical individuals could use this bill to bring down their reputable competitors. It will also create a lot of protest if it passes and once many Americans realize how their online liberties are detrimentally affected. I could see a few Americans getting caught off guard when they are accused of breaking the law for the first time.

    With as much outcry as I’ve been seeing lately from normal constituents I don’t see how any politician could support this bill or even consider it. Supporting the bill would be like a death sentence to them. But, hey, it’s their choice if they want to serve next term or not… we’ll see how many actually listen to constituents.

      I’m actually surprised at some of the candidates that were supporting the bill. If Obama goes for this I will fall out of my chair. Wasn’t he the big Social Media guy during his election? It just makes no sense. I think there all too busy sitting around in the Oval Office making up ineffective bills, and passing bullshit laws, and don’t have a clue about the Internet sector

    Wow Chad , such a great explanation on SOPA, I could see the consequences , as a simple end user i would want the freedom to view any sites that i like and say if ISPs display the message , you cannot view this site cos they violated bullshit , it would be like sitting in my office computer and firewall displaying the message oops , you cannot view this site sorry , it totally sucks to have a firewall for the whole internet and govt deciding what shd i view.

    Good Points Chad, and I support the destruction of this bill. I am all for eliminating piracy, but this bill clearly goes too far, I am sure that if the bill is defeated, there will be more to come, but defeating this one will force the bill makers to create something that is more realistic and less draconian.

This is what those in totalitarian governments are shackled by. This kind of government control should never be allowed.

Imagine a nation without “fair and balanced news” you need to hear both sides of the story to determine what is actually the truth. You say totalitarian, I say dictatorship, its the start of something detrimental. Next there going to be telling us where we can work, what religion we can practice, people think I’m crazy but this is going to open up the doors to Pandora’s Box. Hopefully we can get it stopped.     I didn’t really know too much about this until I read your post… WOW! If this goes ahead it spells bad times for all of us. I am in the UK and the repercussions would affect us drastically over on this side of the pond as well. Lets hope that common sense prevails and dictatorship is not given the green light.

    Thank you for the detailed article and informative content. I just started as an Internet Marketer in December. I saw the internet as a place where I could go an make a few extra dollars to support the Amercian Economy and start a “small business”. I thought that was the American Dream and what our Government was promoting for all of us. Guess not…

I hope that everyone realizes that the special interests, or the greater good, or the honest politicians, or the best interests of capitalism do not matter in politics.

    The truth is that if I have a movie company or a record company and see the internet as a threat than I will pay off 600 politicians with whatever it takes to make sure that I have the laws that I want and need. The only way that we win this battle is to make sure that no one in Washington things that they will be re-elected this November if they pass a bill that curtails freedom on the internet for us to build ecommerce sites and to have people keep making money and spending money to keep the economy strong.

    You did the right thing by explaining that this bill will effect all of us around the world. To support the protest we redirected all our websites on the 18 of January to the SOPA site. We have also send out the message to all non US citizens to sign the petition and support the efforts to stop this crazy idea from the Senators who are in favor off the bill. Let’s hope they will get a lot of protests calls, letters, emails and petitions and for once listen to the people they will effect with these stupid ideas.

    Anyway Chad you’re taking action, thats what we all should do.

    Wow. Now that’s an intelligent rant and a half. I’ve been trying to get some of my friends up here to pay attention, but get the same old feeling of “it doesn’t affect Canada.” Oh yes it does! I for one love Netflix, Vudu, Boxee. I’ve cut cable out completely and don’t miss it. I worry what this could do to true free choice. Thank you for telling it like it is. I’ve FB’d your post. :)

    Just another wonderful power grab by the government on behest of the corporations to help the rich and the powerful and no one else. If this is not proof that the gov’t doesn’t work for us and democracy is a sham I don’t know what is. The people don’t want it, but because 50 power corporations want it then it will be law.

    That’s why we were made as a republic, not a democracy.

    Hey Chad,

    Great post with a ton of good info. I have never been into politics and have always had a general dislike for any politician or community council members.

    I remember a while back in my hometown of Edinburgh, that the counselor assigned to traffic management and road layout in the city didn’t even have a drivers license. Go figure. To me this is generally what happens in politics. You get a bunch of people making decisions and passing bills on stuff they know little or nothing about or the consequences those decisions have for everyday folks.

    Keep up the good work – keeping us all informed…

      Yeah I hear ya, unfortunately I am in to politics. I want to make sure my vote is the right one. These are the signs I look out for in these candidates. You know what though, this isn’t just about politics, this is a decision that is going to affect everybody’s lives!

      I’m going to use your comment to provide an update, I was real snotty with people and told them if you object to this post, I could care less. I expected to get a flood of oppositions. There was not one negative comment at all. That should tell us all something, that should tell congress something.

    Thanks for your honest opinion about sopa and pipa, you are straight forward like always and that is what I like about your blog. Below you see my opinion about this topic.
    I am German, round about 70 years ago we have had a very crazy guy leading our country. You all know who I mean and you all know what happened during this time. But lots of people ask us Germans now “HOW COULD YOU LET SOMETHING LIKE THAT HAPPENED?”. My answer: it all starts like sopa and pipa. Slowly he did everything to cut the free mind of the people and using his propaganda to control there minds. With this said I do not want to say that the US Government does the same like our crazy German leader from 70 years ago but they start off the same way by cutting your rights of a free mind. The US stands for liberty and allays fighted for there rights to be free. Now it is time to fight against your own government for the Freedom of speech. Now it is time to show the world that you do not allow the US government to do the same like the crazy little bugger from Germany, 70 years ago…

      Andy whats up Brother! It does affect everybody. I just got word a couple minutes ago that a ton of the senators backed down. As it stands now 63 are for the bills, 64 are against. We’re not there yet but we are gaining. I have a call with my Senator tommorow, so hopefully we can get him to turn too. Turns out the people do have a vote. Now go launch some more Killer DIGI Plugins!

    Well I have to say this is the best post I have seen on SOPA and PIPA yet. Especially love the pic of my Congressman at the top of the page!

    I talked about this a lot in the Ask Sean session last night and really would encourage everyone to contact your senator and congressman to complain at them if they support and congratulate them if they oppose this. Hitting both sides makes sure no-one sways back to the darkside!

    i don’t know if anyone else sees it but something about this sopa and pipa garbage is standing out like a sore thumb, if you take a look at the recent arab spring, you’ll notice that the people who rose up used certain tools to organize and eventually overthrow their regimes, i know its gone badly in egypt but the focus here is the tools that where used to organize, Facebook, Twitter and youtube to show the outside world what’s going on, now as it’s been mentioned the proposed bills will or could affect such sites as , youtube, Facebook and twitter as well as vimeo and so on, basically what it seems like to me is America is pre-empting what we are witnessing throughout the world, if America can stop these sites from operating then you disable the potential to organize quickly and if you then take away the means to show the outside world what’s happening and you control the Media, and put in place a bill that is nothing more than a Salem revisitation. meaning that all it takes for an american citizen to be carted off and disappear is for someone to mention the T-Word, and any potential for an uprising is removed leaving the American government to have free reign to do as it wishes with its own people, just something that seems to stand out with the new bills threatening to be passed.

    Well written post Chad! I agree with everything said and being an owner of a few websites myself, I cannot imagine the anger I would feel seeing that on my site at some point. Some people have poured 30 years + into their online businesses and for that to just be taken away so easily because of some stupid bill that benefits only greedy and filthy rich movie/music studios, then what’s the point of being the Land Of The Free anymore? I am strongly against these and will definitely be making my voice heard about it too!

    Wonder how much bribes these senators must have received from those big wigs in the entertainment industry and the US government as well. My take on this is that this is a conspiracy to implement a big brother type of government and now that is not all that they are working on. They are even trying to enact ACTA (Anti-Counterfeit Trade Agreement). This is a more global scale of those bills. Here Big Brother will force other countries to join their cause. Users and sites will not just be banned but also it will give the right to spy on users who share on private networks. The government is living in a state of paranoia and is trying to censor freedom of speech and the rights of everyone. We really to stop this insane bills. The internet is the last frontier of freedom. They will use these bills to cover up the truth so they can get away with murder. Check out the Anonymous news on tumblr.

    In reference to Obama saying he wouldn’t sign SOPA or PIPA if it went through, in the past he had wrote a note saying that he didn’t like certain provisions in the NDAA which gives them the power of indefinite detention, they can arrest you for any reason, and keep you without trial, but he signed the darn thing anyway. I don’t think we can count on him for anything.

    Chad,

    I agree with a lot of things you discussed in this post.

    Government should be promoting policies that encourage small businesses, including internet businesses, to grow and prosper. SOPA and PIPA do the opposite.

    If these bills get approved it will give an opportunity for decision makers in government agencies to “block” sites and intimidate small business owners with all sorts of fines and criminal investigations, maybe even federal investigations. Many people are aware of abuse of power in Food and Drug Administration (FDA) back in 70s through 90s. I do not want to see another government agency getting involved in small business operations. This opens the door for abuse of power, dictatorship, bribes and bureaucracy.

    Instead of focusing on brining manufacturing jobs back to United States, they waste time on bills like SOPA and PIPA that do a lot more harm than good.

    If passed, this bill could have sweeping ramifications. Not only would small businesses have to tread carefully for fear of being blocked, but hugely popular websites. It may turn out to people being conscious of using social networks which would decrease the online communication to a large extent. If a bill can change the Internet to its very core, it can certainly affect the way you do business.

    I was quite surprised to see such bills even get considered in the first place. It is depressing to see how much pull the media companies have over the government that they can slip in such blatant violations of our freedom of speech rights. We netizens have to be on our toes and protest any such future bills as soon as they pop up because I’m sure we haven’t heard the last of it.

    While I believe that there should be a form to “protect” copyright infringements, I think that the way the SOPA as it looks, may seriously hamper the overall efficiency of the internet… It comes to a point that I have to think if when writing a post, I can or can not use say the word “Apple”…

    ACTA 2.0 is like a backdoor way to enact SOPA. If the government were to control the internet that would eventually allow complete control on what info/news they want to be shown, and the ones they want to hold on to…….which would turn the internet into complete BS, as is? the media nowadays.     This is all so true. These bills were so badly thought through and I was proud of the people in the web sector standing up for their rights! The principle that a site could be shut down because one of their users was going against their terms and conditions and breaking someone’s copyright is ridiculous! That would be like arresting the mayor of a town because someone was caught speeding on one of the roads there. The person committing the crime should be responsible, not the people who own the place that it was committed. Great post, thanks for sharing!
